I work at a baseball park and there are potentially five different bars you could work at. The management now wants to make the bartenders split tips. We have not done this for the past five years and now half way through the season they want to do it. They are only planning on splitting tips between four of the five bars and the other bar does not have to split. Is that legal to split tips but not make some bartenders split?

I don’t think any tips are really legal, but morally speaking tips are for the individual that served. Normally though a tips jar would be shared amongst staff regularly unless you have an alchoholic working behind the bar. If that were the case then I reckon staff need to meet with the boss. Tips are given by customers for good service anyway for the individual that served them. In England a service charge is usually added to the bill so tippin is not normal unless excellent service has been given.

There is nothing in law to state who should keep tips, if they wanted to the owners could say you had to hand them over to them.
In fact a lot of places do this with credit card tips, the business gets them, not the workers.
IMHO splitting is the fairest way of doing it, that way the blonde with long legs & big boobs who does very little other than flirt with the customers doesn’t get more than the hard worker who has to cover their work while they are doing this.
